Facts
- Kristoph and Phoenix dine for 2 hours
- as Kristoph is leaving, Zak Gramarye (and presumably Spark Brushel) arrive.
- There is a five minute window for something to occur here
- Gramarye meets with Phoenix, they have their fateful conversation with notary present.
- Olga slips the card into Phoenix’s pocket, he removes it and puts it in a bottle.
- Gramarye and Phoenix go downstairs and play cards
- Olga puts the ace in the hand, and the fight starts
- The cheat fails, Zak goes crazy and attacks Olga, (at least apparently) knocking her out.
- Phoenix goes upstairs to call the police on Zak.
- At this time there are no credible witnesses in the room. Olga has lied about the situation repeatedly, we can’t take Kristoph’s word, and Zak dies
- When Wright comes back into the room, he finds Zak dead. Zak’s hat is off, and he is facing the table. On the table, an Ace has been switched for a King.
- Phoenix deduces from the presence of the King that a card must have been taken away for incriminating evidence. He further deduces that the reason for switching the cards must be to hide the position of the killer.
- Phoenix calls Kristoph and becomes suspicious of him. He puts Zak’s hat back on his head.
Questions
- At some point, the bottles that are used are switched. Phoenix asserts that this was done by Kristoph, but in order to do that at the time of the murder, Kristoph– or anyone else– would have to go upstairs to where the bottles were, and where Phoenix was calling the police. The bottles could be switched later, by someone with access to the crime scene.
- There is a five minute window when Zak arrives, and when Kristoph is leaving in which Zak might have had his hat off, and Kristoph could have seen his head.
- Why would Kristoph take away a bloody ace of spades and not replace it with a second ace? Why would he replace it with a king? There were plenty of cards available.
- What is Zak’s motive for framing Phoenix? Why is he so angry that it fails that he attacks someone?
